The Court of Appeal ordered the airline to pay two different passengers’ legal costs
According to the Helsinki Court of Appeal, in particular, a significant number of matters relating to compensation disputes are underway in the Eastern Uusimaa District Court.
The Helsinki Court of Appeal obliges the airline that lost in the case of compensation to pay the costs of the air passen’s reasonable legal costs. The decision applies to two litigation issues for the cancellation of the flight. The Court of Appeal gave its decision on Friday.
In particular, a significant number of matters relating to compensation disputes between air passengers and airlines are underway in the Eastern Uusimaa District Court.
The unanimous decision of the Court of Appeal differs from the district court’s previous decision.
The district court had ordered the airline to pay the passenger compensation for the canceled flight, but rejected the passenger’s legal requirement. The District Court considered that there was no evidence that the passenger was responsible for the expenses incurred by the agent for the proceedings.
On the basis of the commission agreement between the passenger and the agent, the agent was responsible for a certain percentage of his costs. Thus, according to the District Court, the required legal costs were not incurred by the passenger and the passenger was not entitled to compensation in that respect.
The Court of Appeal considered that the arrangement between the passenger and his agent did not limit the airline’s obligation to reimburse the passenger’s reasonable costs.
The Court of Appeal amended the district court’s judgments of the passenger’s liability for the costs of the passenger and ordered the airline to pay them to the passenger.
