The victim and the convict met in Jamaica through mutual friends. The victim was in the country on a hobby and holiday trip. They first had consensual sex.
A few weeks after the first meeting between the victim and the convict, they ended up in the same bed for the night. According to what he said, the victim was intoxicated and very tired at the time. The convict had previously offered the victim cannabis.
They had consensual oral sex. After this, the victim fell asleep.
According to the verdict, the victim realized that the convict was having unprotected vaginal intercourse with her, holding her by the hips.
The victim told the convict at the time that the act was not a good idea. Despite that, the convict continued to have intercourse. Only after the second ban did he stop.
The woman fell asleep again. After that, the convict reunited with the victim several times without her consent.
The convict also tried to forcefully join the victim’s mouth.
Verdict: Actions show indifference
The convict claimed that the victim wanted to take revenge on him for being more interested in another woman with rape allegations. According to the judgment, such an explanation was not credible.
The court considered the victim’s account of the events to be honest and not exaggerated.
According to the verdict, the convict took advantage of the victim’s sleeping space, aware of her reluctance to have intercourse.
– The actions show the defendant’s indifference to the prohibitions and remarks of the person concerned, as well as the understanding that he is forcing or trying to force the person concerned into sexual intercourse, the judgment is justified.
In addition to imprisonment, the court ordered the convict to pay 15,000 euros in compensation to the victim.
