Koivistoinen’s berry farm wins Marjex in court, but may not get the money
The Päijät-Häme District Court ordered Marjex to pay Koivistoiselle more than EUR 250 000. However, before the judgment, Marjex went bankrupt.
Koivistoinen Strawberry Shop in Lahti has won a dispute in court over claims against Marjex Strawberry Shop. The Päijät-Häme District Court ordered Marjex to pay more than €250 000 plus default interest.
In spring 2022, Sotkamo-based Marjex acquired the operations of Koivistoinen Mansikkapaikka in Hollola and Vantaa. The companies entered into an assignment agreement under which Koivistoinen will, among other things, manage strawberry cultivation and act as a consultant to the company’s management. Koivistoinen was to invoice Marjex for the work carried out.
Koivistoinen claimed from Marjex the claims, late payment penalties, contractual penalties, legal costs and compensation for the purchase of seedlings as agreed in the contract.
Marjex denied part of the demand.
The company considered that it was not obliged, among other things, to pay the rent for Koivistoinen’s equipment, as Marjex also had similar equipment. According to Marjex, Koivistoinen had caused legal costs because it did not want to find reconciliation. That is why Marjex thinks Koivistoinen also had to pay Marjex’s legal costs.
Koivistoinen received his claim in the decision.
Last fall, Marjex applied for corporate reorganization and said he was insolvent. According to a preliminary list of debt to the District Court, the company had a debt of EUR 2.5 million.
